Privacy Policy

1. Purpose
This Privacy Policy explains how Smarty Marty collects, holds, uses and discloses personal information.
Where Smarty Marty is subject to the Privacy Act 1988 (Cth) and Australian Privacy Principles, those obligations apply according to law.
The Privacy Act generally requires covered organisations to maintain a clearly expressed, current privacy policy identifying the kinds of information collected, collection and storage practices, purposes, access and correction processes, complaint handling and likely overseas disclosures (OAIC).
2. Information we may collect
Depending on how you use the Website or Services, we may collect:
- name;
- email;
- telephone number;
- billing information;
- booking information;
- education and university details;
- course and subject information;
- employment history;
- professional qualifications;
- career objectives;
- CVs;
- cover letters;
- LinkedIn URLs or profile material;
- job advertisements and position descriptions;
- assessment instructions;
- drafts;
- marking rubrics;
- lecturer or recruiter feedback;
- professional biographies;
- communications with us;
- uploaded files;
- Website usage information; and
- other information voluntarily provided.
We encourage clients not to provide sensitive information unless reasonably necessary.
3. How information is collected
Information may be collected through:
- Website forms;
- checkout;
- questionnaires;
- file uploads;
- email;
- telephone or video calls;
- scheduling platforms;
- payment providers;
- direct communications; and
- Website analytics or cookies.
Where the APPs apply, reasonable steps should be taken at or before collection to inform individuals of matters including identity, purpose, usual disclosures, relevant consequences and overseas disclosures where applicable (OAIC).
4. Why information is collected
Information may be used to:
- assess suitability for a Service;
- provide purchased Services;
- prepare for consultations;
- review documents;
- create client deliverables;
- communicate with clients;
- administer bookings;
- process payments;
- maintain business records;
- respond to enquiries;
- improve Website functionality;
- comply with legal requirements; and
- send marketing where lawful consent exists.
5. Uploaded documents
Documents uploaded through the Website are used only for purposes reasonably connected with the relevant engagement or another purpose permitted by law.
Clients should not upload unnecessary:
- identification documents;
- banking details;
- health records;
- privileged legal documents;
- confidential employer material;
- third-party information; or
- other sensitive content.
6. Service providers
Smarty Marty may use external service providers for functions including:
- website hosting;
- cloud storage;
- payments;
- scheduling;
- email;
- video conferencing;
- analytics;
- document processing; and
- AI-assisted productivity tools.
The final published policy should identify the principal providers actually used where appropriate and state whether personal information is likely to be disclosed overseas.
APP privacy policies should disclose likely overseas recipients and, where practicable, the relevant countries (OAIC).
7. AI-assisted processing
Smarty Marty may use AI-assisted software to support drafting, editing, analysis or administrative work.
We will not intentionally provide personal information to a public AI system for the purpose of training that system.
Where personal information is processed by an external AI or cloud provider, use will be subject to the provider’s applicable service arrangements and our privacy obligations.
8. Storage and security
Reasonable steps will be taken to protect personal information against misuse, interference, loss and unauthorised access, modification or disclosure.
No online or electronic system can be guaranteed completely secure.
9. Retention and deletion
Personal information will be retained for as long as reasonably necessary for:
- the engagement;
- business administration;
- legal or accounting requirements;
- dispute resolution; or
- another lawful business purpose.
Information that is no longer reasonably required should be securely deleted or de-identified where appropriate and lawful.

You may request access to personal information held about you or request correction of inaccurate information by contacting marty@smartymarty.com.au.
11. Privacy complaints
Privacy concerns may be directed to the same email address.
We will consider and respond to complaints within a reasonable period.
Where applicable, individuals may also have rights to complain to the Office of the Australian Information Commissioner.
12. Marketing
Purchasing a Service does not automatically enrol a client in unrelated marketing communications.
Where marketing emails or messages are sent, the Spam Act requires consent, sender identification and a functional unsubscribe mechanism (ACMA).
Marketing consent should therefore use a separate unticked checkbox.
13. Changes
This policy may be updated periodically.
